If you are detained

  • You have the right to remain silent. You do not have to answer questions about where you were born or your immigration status.
  • You have the right to speak to a lawyer. Say clearly: “I want to speak to a lawyer.” You can ask for a list of free/low-cost legal providers.
  • Do not sign any document you do not fully understand — especially “voluntary departure.” Signing can waive your right to see a judge.
  • Ask for your A-number (Alien Registration Number). Your family needs it to find you and to hire a lawyer.
  • You have the right to contact your consulate and to make phone calls from detention.
  • If you fear returning to your country, say you are afraid and that you want to apply for asylum — this triggers a “credible fear” interview.

For families of detainees

  • Find your relative using the ICE Online Detainee Locator (locator.ice.gov) with their A-number or full name, country of birth and date of birth.
  • Write down the detention center name, address and phone number — you will need it for lawyers and visits.
  • Contact an accredited immigration lawyer or a non-profit legal aid organization as early as possible.
  • Keep copies of ID, passports, prior applications and any evidence of danger in the home country.
  • You can send money for phone/commissary and request bond information; a judge may set a bond for release.

This is one of the most important things to understand before you apply. In general, if you seek asylum in one of these countries, you usually cannot apply for asylum in another one at the same time. Most states treat asylum as a single, active claim: once you lodge it, that country becomes responsible for your case, and a second claim elsewhere can be refused, suspended, or returned to the first country.
